County Assembly Leadership

(1) County Assembly Speaker

Article 178 (1) of the Constitution of Kenya provides that each County Assembly shall have a speaker elected by the County Assembly from among persons who are not members of the Assembly. (2) A sitting of the County Assembly shall be presided over by-- (a) the speaker of the Assembly; or (b) in the absence of the Speaker, another Member of the Assembly elected by the Assembly. (3) Parliament shall enact legislation providing for the election and removal from office of speakers of the County Assemblies.

Anyone wishing to be a Speaker of the County Assembly must meet qualifications under Article 193 of the Constitution of Kenya 2010 and Sections 22 and 25 of the Elections Act 2011. The qualifications include;

He/she must be a registered voter.

Should satisfy any educational, moral and ethical requirements as prescribed in the constitution. The educational requirement is a post-secondary school qualification recognised in Kenya, in accordance with Section 22(1) of the Elections Act 2011.

Be a Kenyan citizen for at least 10 years before the election.

Should not hold dual citizenship or owe allegiance to a foreign state.

Be elected in accordance with standing orders of the respective county assemblies, from persons eligible to be elected as Members of County Assembly but are not such members.

An applicant shall be disqualified from being elected as speaker of the county assembly, in accordance with Article 193 of the constitution if:

He/she is a state or public officer.

Is of unsound mind

Is an undischarged bankrupt.

Is serving a sentence or imprisonment of at least six months.

Has held office as a member of IEBC within five years before the date of the election.

Has been found to have misused or abused a state or public office, in accordance with laws of the constitution of Kenya.

(2) County Assembly Deputy Speaker

In the absence of the Speaker or whenever the requested, the Deputy Speaker takes the Chair and has the same powers and functions as the Speaker. The deputy Speaker is also the Chairperson of the Committee of the Whole House.

(3) County Assembly Majority Leader

The office of the Leader of Majority Party (and deputy Leader Majority) is established pursuant to Section 10 (1) of the County Governments Act No. 17 of 2012 and Standing Order number 20 (1), (2). The Leader of Majority Party is elected from amongst members from the largest party or coalition of parties and spearheads the legislative agenda of the largest party or coalition of parties in the Assembly.

(4) County Assembly Minority Leader

The Minority Leader speaks for the Minority Party and its policies, strives to protect the minority’s rights, organizes and leads criticism of the Majority Party, and devises parliamentary strategies and tactics that can put to best use the abilities of his party to influence legislative outcomes. The Minority Leader chairs his party’s Committee Assignment Panel

(5) County Assembly Majority Whip

The office of the Majority Party Whip (and Deputy Majority Party Whip) is established pursuant to Standing Order number 20 (3), (4). The Majority Party Whip is elected from amongst members from the largest party or coalition of parties and performs the functions of the office of the Leader of the Majority Party in the absence of both the Leader of the Majority Party and the Deputy Leader of the Majority Party pursuant to Standing Order number 20 (6).

(6) County Assembly Minority Whip

The office of the Minority Party Whip is established pursuant to Standing Order number 21 (3), (4). The Minority Party Whip is elected from amongst members from theleast party or coalition of parties and performs the functions of the office of the Minority Party Whip
